Fendi Claims Burlington Still Selling Counterfeits

Law360 (July 19, 2007, 12:00 AM EDT) -- Posh fashion company Fendi S.A. has asked a New York federal court to rule that retailer Burlington Coat Factory Warehouse Corp. continues to violate its trademarks by allegedly ignoring an agreement between the companies not to sell counterfeit Fendi products.

In a declaration filed with the court Wednesday, Fendi attorney Richard L. Mattiaccio has asked for summary judgment that Burlington is in contempt of a 1987 injunction in which the retailer agreed not to sell any merchandise bearing Fendi's trademarks without the Italian company's permission....
