Atty's FCRA Suit Over PACER Receipt Heads To High Court

Law360, New York (January 17, 2012, 5:03 PM EST) -- The U.S. Supreme Court agreed Friday to hear a lawyer's proposed class action alleging his credit card expiration date was illegally disclosed in an online PACER receipt, after the U.S. contended the suit's revival could usher in “vast” federal liability under the Fair Credit Reporting Act.

In its petition for review filed in August, the federal government argued that the Federal Circuit's decision to resurrect the case could have major implications for the U.S.' potential liability in light of FCRA's scope.
