ECJ Urged To Toss Appeal Of Chinese Anti-Dumping Ruling

Law360, New York (January 19, 2012, 3:28 PM EST) -- An advocate general of the European Court of Justice on Thursday urged the court to toss an appeal of an EU General Court ruling that annulled anti-dumping measures imposed on imports of the herbicide glyphosate from China.

At issue is a decision by the European Commission and the Council of the European Union to refuse to grant market economy status to Chinese herbicide manufacturer Zhejiang Xinan Chemical Industrial Group Co. Ltd because it is under state control, according to the advocate general’s opinion.
