4th Circ. Upholds GSK Win In Vaccine Contract Suit

Law360, New York (January 19, 2012, 6:31 PM EST) -- The Fourth Circuit on Tuesday upheld a win for GlaxoSmithKline PLC in a contract interference suit brought by Infection Control Consultation Services Inc., ruling that the health care giant hadn't caused the small business to lose a government contract for vaccine distribution.

ICCSI, which held a contract with the Substance Abuse and Mental Health Services Administration to distribute and track GSK's hepatitis vaccine Twinrix, alleged that the drug company's interference caused the agency to choose another contractor when the testing program was renewed in 2006. But...
