Merck Unit, Pamlab Sue Over Generic Metafolin

Law360, New York (January 19, 2012, 9:26 PM EST) -- A Swiss unit of Merck KGaA and Pamlab LLC filed suit in Texas federal court Thursday accusing Macoven Pharmaceuticals LLC and biotech firm Gnosis SpA of making generic folate supplements that infringe six patents for Merck's supplement ingredient Metafolin.

Merck & Cie manufactures the chemical L-methylfolate under the name Metafolin, which is used by Louisiana-based Pamlab in several nutritional supplements covered by the patents, according to the complaint. Macoven and Gnosis work together to manufacture products which claim to have the same ingredients as Pamlab's, infringing the patents, the complaint alleges.
