Expert Testimony OK In Miscarriage Drug Suit: Judge

Law360, New York (January 19, 2012, 10:40 PM EST) -- In a blow against 14 drug companies battling class action claims over anti-miscarriage drug diethylstilbestrol, a magistrate judge ruled Thursday that the plaintiffs had adequately supported expert testimony that prenatal exposure to the drug increases the risk of breast cancer in women over 40.

The suit was sent to mediation after U.S. Magistrate Judge Marianne B. Bowler denied the motions to exclude the testimony by the drug companies, which include Eli Lilly & Co. and Bristol-Myers Squibb Co. The companies claimed the testimony didn’t meet the...
