9th Circ. Cuts AIU From Seagate Coverage Dispute

Law360, New York (January 20, 2012, 8:34 PM EST) -- The Ninth Circuit on Friday ruled that American International Underwriters Insurance Co. had no duty to defend Seagate Technology Inc. in an underlying patent suit brought by Convolve Inc., but that two other insurers must defend the hard drive company.

The three-judge panel partially reversed a September 2010 judgment out of California federal court that found AIU was responsible for defending Seagate because the company's policies under its two primary insurers, National Union Fire Insurance Co. of Pittsburgh, Pa., and American International Speciality Lines Insurance Co.,...
