High Court Won’t Consider LA Grocery Employment Rule

Law360, New York (January 23, 2012, 4:10 PM EST) -- The U.S. Supreme Court on Monday refused to take up a trade industry group's claims that a Los Angeles city ordinance requiring new grocery store owners to employ a store's previous employees for 90 days is preempted by federal labor law.

The high court denied a petition for certiorari lodged in November by the California Grocers Association after the California Supreme Court ruled that the ordinance was neither preempted by state laws covering health and safety, nor by federal laws regulating collective bargaining.
