Kagan Recusal Arguments Nixed In High Court Health Fight

Law360, New York (January 23, 2012, 6:27 PM EST) -- The Supreme Court on Monday declined a motion by the conservative watchdog group Freedom Watch to present oral arguments in support of its claim that Justice Elena Kagan should recuse herself from challenges to the Obama administration's health care reform law.

Freedom Watch asked for 10 minutes of oral argument in addition to the 4 1/2 hours of argument already scheduled on the constitutionality of the law. In its denial, the court said Justice Kagan didn't participate in deciding the motion.
