Aera Energy May Be Hit With More Damages

Law360, New York (July 23, 2007, 12:00 AM EDT) -- A California farming family has won a retrial in its case against an oil company owned by Exxon Mobil Corp. and Shell Oil Co., after arguing that the $3.8 million damages it was originally awarded were not enough.

The evidence claiming that Aera Energy LLC’s oil productions contaminated the groundwater under a neighboring farm does not support the $3.8 million sum and suggests that the jury was not properly instructed on how to calculate damages, the California State Appeals Court ruled on Friday.
