Ill. Can Look To Unions To Set Public Project Wages: 7th Circ.

Law360, New York (January 31, 2012, 6:52 PM EST) -- The Seventh Circuit on Tuesday affirmed the dismissal of a suit brought by landscape contractors who claimed the Illinois Department of Labor violated the Fourteenth Amendment by delegating the determination of wages for workers on public projects to private parties like labor unions.

The appeals court said the plaintiffs, led by Beary Landscaping Inc., had failed to show that the Illinois DOL's decision to group plantsmen — workers who perform landscaping tasks — with other construction laborers was unreasonable.
