11th Circ. Reopens Suit Claiming HIV Kept Man Off Force

Law360, New York (February 2, 2012, 8:43 PM EST) -- A man who claims the city of Atlanta refused to hire him as a police officer because he was HIV-positive is entitled to an evidentiary hearing on whether he can be denied the position based on his condition, the Eleventh Circuit said Wednesday.

A three-judge panel vacated the 2010 dismissal of the American Disabilities Act suit brought by a man using the pseudonym Richard Roe, and remanded the suit to Georgia federal court. The panel said the lower court must consider evidence regarding the city's stance...
