Appeals Court Goes Along With Ruling Against Workers

Law360, New York (July 26, 2007, 12:00 AM EDT) -- An appeals court upheld a lower court ruling Wednesday concerning the retirement plan for union employees of Siemens Corp. and CBS Corp., saying that the workers were not entitled to a benefit of the plan because they had decided to work for the company that bought their former employer.

The decision of the three-judge panel of the U.S. Court of Appeals for the Eleventh Circuit disappointed Kenneth McCay, John Brannon, Clifford Hawthorne and Paul Jones, who had appealed a May 2006 ruling by the United States...
