5th Circ. Leaves Insurers On Hook In Ambulance Injury Suit

Law360, New York (February 6, 2012, 7:44 PM EST) -- The Fifth Circuit on Friday upheld a lower court’s ruling that two insurance companies must defend an ambulance service that was sued after a woman sustained fatal injuries while being transported, finding neither insurer’s exclusions or policy language excused them from coverage.

In a published opinion, the three-judge panel found both the National Casualty Co. and Western World Insurance Co. are responsible for defending Preferred Ambulance Inc. in an underlying Texas state court suit, and that Western must reimburse National for its equal share of defense...
