BellSouth Must Comply With Telecom Rule: Court

Law360 (July 26, 2007, 12:00 AM EDT) -- BellSouth Telecommunications Inc. will have to comply with a state utility commission's rule requiring to open its services up to smaller competitors, an appeals court has ruled, overturning a district court decision declaring the rule invalid.

The North Carolina Utility Commission's rule forcing dominant telecom provider BellSouth to offer smaller resellers the same “cash back” incentive it offers subscribers is legitimate under the federal Telecommunications Act of 1996, the Court of Appeals for the Fourth Circuit ruled on Wednesday.
