9th Circ. OKs DOE's Risk Assessment Of Viruses In Nuke Lab

Law360, New York (February 7, 2012, 4:49 PM EST) -- The Ninth Circuit on Tuesday ruled the U.S. Department of Energy had adequately assessed the environmental impact of a California nuclear weapons laboratory with a facility containing lethal viruses, after an environmental group claimed the DOE hadn't sufficiently accounted for potential terrorist attacks.

Siding with a California federal court’s September 2009 decision, a three-judge panel found the DOE had sufficiently revised its environmental assessment of a biotoxin facility at its Lawrence Livermore National Laboratory after nuclear cleanup watchdog Tri-Valley Communities Against a Radioactive Environment argued inadequate...
