Anti-SLAPP Denial Not Appealable In Extortion Case: 9th Circ.

Law360, New York (February 13, 2012, 10:21 AM EST) -- The Ninth Circuit ruled Thursday that a California lawyer and four consumers can't immediately appeal a denial of their bid under Nevada's anti-strategic lawsuits against public participation law to dismiss a nutrition supplement maker's extortion suit over their threats to sue for false advertising.

In a published opinion, the Ninth Circuit ruled that motions to dismiss under Nevada's anti-SLAPP statute aren't immediately appealable, in part, because the statute is not intended to provide immunity from being sued.
