EPA Overreached With Greenhouse Gas Rule, DC Circ. Hears

Law360, New York (February 9, 2012, 7:55 PM EST) -- Texas and Wyoming told the D.C. Circuit on Wednesday that the U.S. Environmental Protection Agency's attempt to take over part of their clean air permitting programs so it could regulate greenhouse gases is unlawful and violates the states' sovereign rights.

The current case, which consolidates more than a dozen suits brought by various state agencies, mining associations and advocacy groups, centers on a December 2010 rule issued by the EPA finding that 13 U.S. states did not have laws in place for regulating greenhouse gas emissions....
