6th Circ. Voids Class Cert. In Cancer Insurance Action

Law360, New York (February 10, 2012, 4:31 PM EST) -- The Sixth Circuit on Friday vacated the class certification granted to a cancer patient who accused Life Investors Insurance Co. of America and parent company Aegon USA Inc. of wrongfully denying policyholders payment on their cancer treatment claims.

The appeals court said in a decision filed Friday that the 2009 settlement of a nearly identical Arkansas class action against the same insurance company precludes certification of policyholder Anthony Gooch's class under state law.
