US Sues Dallas Drug Compounder Over 3 Colchicine Deaths

Law360, New York (February 10, 2012, 7:43 PM EST) -- The U.S. Department of Justice sued Dallas-based pharmaceutical company ApotheCure Inc. and charged its owner on Friday over shipments of allegedly mislabeled colchicine that prosecutors say led to three deaths.

The DOJ claims that in March 2007, ApotheCure, a compounding pharmacy, made a shipment of 72 vials of the product, used to prevent and relieve gout attacks, some of which contained much higher or much lower doses than were labeled.

ApotheCure’s alleged mislabeling amounted to two misdemeanor criminal violations of the Federal Food, Drug and Cosmetic Act. The...
