Dismissal Of CIBC Suit Reversed—Again

Law360 (July 30, 2007, 12:00 AM EDT) -- A putative class of investors suing two firms for allegedly aiding InterBank Funding Corp.'s securities fraud will get a third chance to persuade a district court that they have successfully pled their case.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit found Friday that the U.S. District Court for the District of Columbia exceeded its reach in dismissing the class's claims against CIBC World Markets Corp. and Radin Glass & Co. with prejudice.
