McKesson Can’t Duck FCA Suit Over Alleged Kickbacks

Law360, New York (February 14, 2012, 4:49 PM EST) -- A Mississippi federal judge on Tuesday turned down attempts by McKesson Corp. and others to end the government's suit accusing them of submitting false claims to Medicare stemming from illegal kickbacks that McKesson allegedly provided to a nursing home chain.

U.S. District Judge Sharion Aycock rejected summary judgment motions from McKesson, its subsidiary McKesson Medical-Surgical MediNet Inc. and nursing home chain Beverly Enterprises Inc. as well as Beverly's affiliates.
