Appeals Court Affirms Qwest Victory In Tariff Dispute

Law360 (July 30, 2007, 12:00 AM EDT) -- Qwest Communications International Inc. need not further compensate Union Telephone Co. for allegedly unpaid toll traffic on Union's network, a circuit court said Friday.

A three-judge panel of the U.S. Court of Appeals for the Tenth Circuit found that Union had not provided an adequate agreement or tariff and therefore had no legitimate basis for its claims for compensation. The circuit court upheld the U.S. District Court for the District of Wyoming's January 2006 finding of summary judgment for Qwest, according to court documents.
