Erie Indemnity Can't Kill Claims Adjusters' OT Action

Law360, New York (February 16, 2012, 5:13 PM EST) -- A Pennsylvania federal judge on Wednesday refused to dismiss a class action against Erie Indemnity Co. brought by claims adjusters who allege the insurance company failed to pay them overtime.

Erie and the worker class filed motions for summary judgment that made such contrary arguments that the case should be “left in the hands of a jury,” U.S. District Judge Sean J. McLaughlin said in striking down both motions in the Fair Labor Standards Act suit.
