Five Claims Blown Out In Wind Farm Rivals' Permit Fight

Law360, New York (February 16, 2012, 2:23 PM EST) -- A California federal judge on Tuesday dismissed five of six claims in a Wind Energy Partnership Ltd. suit over a rival's wind project sited near its own in Palm Springs, Calif., ruling that the rival's permit did not violate local zoning laws or the Fourteenth Amendment.

Judge Manuel L. Real said that a wind farm project by NextEra Energy Resources LLC on land abutting Wind Energy's existing wind farm received the required approval under the Palm Springs zoning code.
