Swiss Regulator OKs Apax's $2B Mobile Co. Buyout

Law360, New York (February 17, 2012, 2:20 PM EST) -- Switzerland's competition watchdog has given European buyout firm Apax Partners LLP the go-ahead to purchase France Telecom SA's cellphone operator Orange Switzerland, leaving the country with three leading network providers, the regulator announced Friday.

After an investigation, the Competition Commission determined that the transaction, worth about $2 billion, would not cause any structural change in the existing cellphone market. ComCo said the continued existence of three separate providers — Swisscom Ltd., Sunrise Communications AG and Orange — will maintain the necessary competitive dynamic.
