Lexington Sues Ace Over Kinder Morgan Blast Coverage

Law360, New York (February 22, 2012, 8:47 PM EST) -- Lexington Insurance Co. launched a suit against Ace American Insurance Co. in Texas federal court Wednesday, seeking a contribution for five underlying suits over a fatal explosion at a gas pipeline owned by Kinder Morgan Inc., an affiliate and another company.

An Ace American policy is primary to two Lexington policies, so Ace American should be held liable for all defense costs and expenses incurred in defending Kinder Morgan, Kinder Morgan NatGas Operator LLC and Midcontinent Express Pipeline LLC, the complaint said.
