High Court Mulls Alien Tort Liability In Shell Nigerian Case

Law360, New York (February 28, 2012, 9:29 PM EST) -- The U.S. Supreme Court on Tuesday grilled attorneys over whether Nigerians can wield the Alien Tort Statute to sue Royal Dutch Shell PLC for alleged human rights abuses, in a case that could determine corporations' potential liability under the 222-year-old law.

In their second-ever case involving the Alien Tort Statute, the justices probed attorneys for Shell and the Nigerians about whether the ATS applied to corporations and whether a case accusing a foreign company of rights abuses in another country even belongs in U.S. courts....
