Eisai Can't Pry Transcripts From 2003 Aventis Antitrust Suit

Law360, New York (February 28, 2012, 6:56 PM EST) -- A New Jersey federal judge on Monday ruled that Eisai Inc. cannot compel Sanofi-Aventis US LLC to produce the deposition transcripts of witnesses who gave testimony in a 2003 antitrust suit, holding the depositions are irrelevant to the current case over Sanofi's alleged hold on the anti-coagulant market.

U.S. Magistrate Judge Douglas E. Arpert held that while the same witnesses were being deposed for the current suit, their prior testimony was irrelevant to the case at hand and thus outside the bounds of acceptable discovery....
