Union's Fee System Unconstitutional, Court Rules

Law360 (August 2, 2007, 12:00 AM EDT) -- The Second Circuit ruled Wednesday that a union could not require non-members to object each year to fees unrelated to collective bargaining, reversing a decision by a New York district court and remanding several other claims the lower court had dismissed.

The court concluded that Professional Staff Congress, a union representing employees of the City University of New York, violated federal labor law and the First Amendment by failing to ensure fair representation of employees who paid its fees.
