Families Toss Bid To Renew J&J, Omnicare Antitrust Suit

Law360, New York (February 28, 2012, 7:35 PM EST) -- The family members of deceased nursing home residents who claim their relatives were victimized by an alleged kickback scheme between Johnson & Johnson and Omnicare Inc. on Monday dropped their bid to revive an antitrust class action against the companies in the Ninth Circuit.

Lead plaintiffs Barton Spindler, Deborah Underwood, Valerie Burks and Parvis Kaveh asked the appeals court to dismiss the appeal with prejudice, the same day that their opening brief was set to be filed.
