9th Circ. Backs Most Of Sierra Club's Lake Tahoe Win

Law360, New York (February 29, 2012, 10:15 PM EST) -- The Ninth Circuit partially upheld a district court ruling Wednesday saying the Tahoe Regional Planning Agency hadn't properly evaluated the environmental impact of new rules for Lake Tahoe's shorelines, but said the lower court should give the agency more discretion as it tries again.

The League to Save Lake Tahoe and the Sierra Club sued the agency in 2008, saying it had adopted amendments to its shoreline ordinances that would allow more boating facilities on the lake without properly considering the environmental impact of the proposal...
