Estee Lauder's Bad Faith Claim OK'd In OneBeacon Dustup

Law360, New York (February 29, 2012, 9:16 PM EST) -- A New York state judge on Wednesday said Estee Lauder Inc. can file a bad faith claim to recover legal expenses in its battle to obtain coverage from OneBeacon Insurance Group LLC for environmental claims against the cosmetics giant.

Trial court Judge Carol R. Edmead referenced a 2009 New York state appeals court decision that Estee Lauder was entitled to a declaration that its defense costs in the underlying matters “must be paid promptly by OneBeacon to the extent that they are reasonable and necessary.”...
