Judge Nixes 'Rambling' Claim In Texas Highway Plan Suit

Law360, New York (March 1, 2012, 3:54 PM EST) -- A Texas federal judge on Wednesday dismissed a portion of a suit by a group of Houston residents alleging that a U.S. Department of Transportation agency improperly approved a local highway expansion plan, ruling the plaintiffs' claims were "repetitive, rambling and difficult to understand."

U.S. District Judge Lee H. Rosenthal said the plaintiffs failed to concisely and sufficiently outline a due process claim under the Fifth Amendment in their case against several U.S. agencies including the Federal Highway Administration. The judge dismissed the case without prejudice...
