Fed. Circ. Tosses Army Contractor's Appeal Over Hotel

Law360, New York (March 2, 2012, 5:52 PM EST) -- The Federal Circuit on Friday upheld the dismissal of a claim filed by a military contractor seeking to force the U.S. Army to rectify an alleged breach of contract for a hotel The Minesen Co. was building at a Hawaii base, saying the suit was duplicative.

A three-judge panel, voting 2-1, said Minesen voluntarily waived its right to appeal to the court under its negotiated contract with the Army’s Morale, Welfare, and Recreation Fund.

Judge William C. Bryson dissented from the majority opinion.
