Judge Won't Halt NH Medicaid Cut Fight, Citing High Court

Law360, New York (March 5, 2012, 2:17 PM EST) -- A New Hampshire federal judge refused Friday to toss claims challenging the state's cuts to Medicaid under the U.S. Constitution’s supremacy clause, saying they required further argument after the U.S. Supreme Court declined to rule on similar claims in Douglas v. Independent Living Center of Southern California Inc.

In the Douglas ruling, the high court declined to decide whether plaintiffs can use the constitutional clause that says federal law trumps state law to challenge California's Medicaid cuts, and sent the case back to the Ninth Circuit...
