Facebook Data Patent Evidence Lacking, Fed. Circ. Hears

Law360, Washington (March 5, 2012, 5:18 PM EST) -- A federal judge should not have accepted a jury verdict that invalidated Leader Technologies Inc.'s data storage patent despite finding that Facebook Inc. had infringed it because there was no clear and convincing evidence, Leader told the Federal Circuit on Monday.

The central question is whether there was sufficient evidence for the jury to meet the clear and convincing standard, and there clearly was not, Leader told a three-judge panel on its appeal of U.S. Judge Leonard Stark's post-trial rulings in its infringement case against Facebook....
