UC Drops 11th Amendment Defense Over $3M Fine

Law360, New York (August 3, 2007, 12:00 AM EDT) -- The University of California has dropped its defense that the Eleventh Amendment immunizes the school system from a $3 million Department of Energy fine over security violations at the university-owned Los Alamos nuclear weapons lab.

The UC said it decided to withdraw the defense after preparing its response to a DOE preliminary notice of violation, which seeks to impose a $3 million fine on the university for alleged violations of DOE security orders under the Atomic Energy Act.
