Charles Schwab Faces New Claims In Overtime Suit

Law360, New York (August 3, 2007, 12:00 AM EDT) -- Customer service specialists seeking overtime wages in a putative class action against Charles Schwab & Co. Inc. have expanded their allegations of Fair Labor Standards Act violations to include breaches of California labor law.

The specialists filed an amended complaint on Friday, which reasserted claims that Charles Schwab misclassified them as exempt under the FLSA, and added new claims that the San Francisco-based investment firm failed to pay for overtime wages and missed meal and rest breaks as required under California law.
