Appeals Court Nixes Bariatric Bed Patent Suit

Law360, New York (August 6, 2007, 12:00 AM EDT) -- The U.S. Court of Appeals for the Federal Circuit has weighed in on a Texas court's decision to throw out a patent infringement claims over a bed designed to accommodate obese patients, upholding the lower court's decision to grant summary judgment and dismiss the case.

The appeals court on Friday affirmed U.S. District Judge Vanessa D. Gilmore's ruling that Burke Inc.'s Tri-Flex II bariatric bed didn't infringe U.S. Patent Number 6,357,065—which had been asserted by SafeTCare Manufacturing Inc.
