Ruling Tossing 2 Plaintiffs From Guidant MDL Affirmed

Law360 (August 6, 2007, 12:00 AM EDT) -- An appeals court has affirmed a lower court's decision to throw out the claims of two plaintiffs in the multidistrict litigation over Guidant Corp. pacemakers and defibrillators, noting the plaintiffs' attorney's failure to provide the court with requested information.

The U.S. District Court of Appeals for the Eighth Circuit handed down its ruling on Wednesday, affirming the district court's decision to dismiss the claims of Steve and Diane Gaydos and deny their motion for reconsideration.
