Fed. Circ. Tells CIT To Scrap Alden Leeds Duty Ruling

Law360, New York (March 8, 2012, 5:21 PM EST) -- The Federal Circuit on Thursday overturned a U.S. Court of International Trade ruling that denied the federal government's bid to nix an anti-dumping duty appeal brought by pool chemical importer Alden Leeds Inc., finding the CIT did not have jurisdiction to hear the case.

The importer brought the complaint after anti-dumping duty rates were published at a rate of 4.07 percent — a rate substantially lower than the estimated duty rate of 24.83 percent that Alden Leeds previously deposited for the importation of its pool chemicals...
