CIT Nails Commerce Ruling On Duties For Target Tool Kits

Law360, New York (March 8, 2012, 6:50 PM EST) -- The U.S. Court of International Trade on Wednesday again struck down a U.S. Department of Commerce ruling that steel nails in household tool kits imported from China by Target Corp. were not covered by an anti-dumping duty order.

CIT Judge Nicholas Tsoucalas again remanded Commerce's determination, saying the nails used in Target’s kits were within the final scope of the anti-dumping order. The judge further found that Commerce’s redetermination was not supported by substantial evidence and not in accord with the law.
