AEX Drivers Score Class Cert. For Wage Action

Law360, New York (March 9, 2012, 2:04 PM EST) -- A federal judge on Thursday certified a class of American Eagle Express Inc. delivery drivers to bring claims that the courier misclassified them as independent contractors in violation of Pennsylvania's Wage Payment and Collection Law, but denied certification for minimum wage claims.

U.S. District Judge Juan R. Sanchez concluded that the plaintiffs had shown that common issues would predominate concerning their WPCL claims, but that they could not demonstrate that this was also the case for their Pennsylvania Minimum Wage Act claims.
