Applying Countervailing Duties To Nonmarket Economies

Law360, New York (March 9, 2012, 1:41 PM EST) -- The U.S. Congress has overturned a decision issued less than three months ago by the U.S. Court of Appeals for the Federal Circuit, which had ruled that the U.S. Department of Commerce has no authority to apply countervailing duties on products of nonmarket economies, such as China and Vietnam.
Under the legislation, which the president is expected to sign just as quickly as the Congress approved it, more than two dozen CVD orders and several pending investigations against products of NMEs will be allowed to stand....
