Prepaid Card System Won't Go Dark Amid Price-Fixing Claims

Law360, New York (March 9, 2012, 4:01 PM EST) -- A Georgia federal judge refused Wednesday to prohibit Interactive Communications International Inc. from operating its reload system for prepaid debit cards in a suit brought by nFinanSe Inc., which claims the system is an illegal price-fixing conspiracy.

U.S. District Judge Amy Totenberg denied nFinanSe’s motion for preliminary injunction, saying she was not convinced that InComm's system constituted an illegal price-fixing scheme between direct, horizontal rivals. The judge also took under advisement InComm’s motion to dismiss the suit, according to a minute order filed Wednesday.
