Judge Douses Class Action Over Amish Fireplaces

Law360, New York (March 12, 2012, 1:24 PM EDT) -- An Ohio federal judge largely dismissed a class action Friday accusing electric fireplace manufacturer Heat Surge LLC of falsely advertising its products as built by Amish workers in the U.S., ruling the allegations against the company lacked sufficient detail.

Judge Benita Y. Pearson tossed claims of fraud, breach of contract and unjust enrichment, as well as class-action claims of deceptive trade practices, upholding only the individual deceptive trade practice allegations from nine consumers.
