FDA To Review TV Drug Ads Before Broadcast

Law360, New York (March 12, 2012, 6:46 PM EDT) -- Pharmaceutical companies may be required to have the U.S. Food and Drug Administration review TV commercials for new or potentially dangerous drugs before the commercials air, according to draft guidelines released Monday.

Under current FDA rules, drug companies are required to submit direct-to-consumer TV advertisements for review when they begin airing, but not before. In 2007, however, Congress passed a law calling for the FDA to begin requiring prior review of drug ads.
