DC Circ. Lifts CVS Pharmacies' Prescription Sale Ban

Law360, New York (March 14, 2012, 6:48 PM EDT) -- The D.C. Circuit on Wednesday lifted the ban blocking two CVS Caremark Corp. pharmacies from selling prescription drugs, stemming from allegations they filled suspicious orders for oxycodone, and gave the U.S. Department of Justice until next Monday to oppose the pharmacies’ emergency injunction request.

A three-judge panel issued the administrative stay so it could consider the merits of the pharmacies’ injunction request that would deep-six the U.S. Drug Enforcement Administration's suspension of their licenses while they appeal a lower court ruling upholding the ban.
