Judge Bans CBP Fines On Union Pacific Over Smuggled Drugs

Law360, New York (March 15, 2012, 2:42 PM EDT) -- A Nebraska federal judge on Wednesday prohibited U.S. Customs and Border Protection from collecting fines on the Union Pacific Railroad over drug smuggling on trains coming from Mexico.

The ruling, which has not been made publicly available, grants the railroad's request for a permanent injunction and prevents Customs and its overarching agency, the U.S. Department of Homeland Security, from leveling fines for illegal narcotics found in Union Pacific train cars.
